4. Confidentiality
Confidential information shall be subject to the following sections 5 (a), (b) and (c);
(a) The receiving party shall protect the confidential information using the same precautions that it uses to safeguard its own confidential , but no less than reasonable efforts;
(i) to not disclose confidential information of the disclosing party to persons or entities other than the receiving party's employee or representatives with a need to know that are involved with performance of the services under this agreement; and
(ii) to not use confidential information of the disclosing party for any purpose other than performing the services under this agreement
