8.3 Starting from the fifth week of delay, Customer may apply a penalty for delay of 0.25 % per complete week up to a
maximum of 5 % if an agreed time limit is not kept due to gross negligence or unlawful intent by rommelag ag, and
Customer provides evidence that it incurred damage as a consequence thereof. The penalty percentages relate to the
price for rommelag ag's work on that part of the Machine that cannot be taken into service in good time because of the
delay. The first four weeks of the delay confer no claim to such damages for delayed delivery, except in the event of
unlawful intent or gross negligence by rommelag ag.
Except in the event of unlawful intent or gross negligence by rommelag ag, all further claims and rights on account of
delay, especially for further damages, are excluded. There is no claim in damages for anears of work during the first 4
weeks of the delay.
