10 The MRTA shall have the right to inspect all Operations Accessories and prohibit the use of defective Operations Accessories (which the Concessionaire shall forthwith remove from the Railway System). The MRTA and the Concessionaire shall jointly carry out an annual stock taking. A stock taking shall also be carried out on termination or expiry of the Agreement.
11 If identical replacement Operations Accessories cease to be available and no compatible updated versions are available, the Concessionaire shall identify alternatives of equivalent quality but shall not proceed with the procurement of such alternatives without the approval of the MRTA.
12 The Concessionaire shall maintain the inventory of Operations Accessories up to date at all times and shall make this available to the MRTA on demand. At intervals not exceeding 12 months and 6 months prior to expiry of the Agreement, the Concessionaire shall arrange for a joint inspection with the MRTA of Operations Accessories.
13 The Concessionaire is responsible for arranging customs clearance for the import of Operations Accessories required for the performance of the Services. The MRTA shall provide such reasonable assistance as is within its capability and is reasonably requested by the Concessionaire, but such assistance shall be without prejudice to the obligations of the Concessionaire.
