Baier [1986, 1994a] also reveals other capacities in the
trustee beyond a good will which are necessary for a trust
relationship. The first capacity is discretion. She states
that "when we are trusted, we are relied upon to realize what
it is for whose care we have some discretionary
responsibility" [Baier, 1986, p.236]. The trustee must
realize the scope of what has been entrusted to him/her and
not do more or less. Unlike a contractual relationship, a
trust relationship may, or may not, explicitly state what is
expected by the truster and trustee. Therefore, good judgment
and discretion are often needed to determine how best to meet
