Voluntary compliance is not a reliable compliance mechanism since unfavorable rulings can be disregarded by the state without major repercussions. Since the Security Council is the organization that makes recommendations or decides upon measures to take if a state does not comply with an ICJ ruling, the P5 members can refuse to enforce rulings that would negatively impact themselves or their allies. Reputational costs can dissuade states from defecting from ICJ rulings, but there have been instances where a state’s interests supersede international laws. An example of this was when the state of Israel ignored advisory opinions given by the ICJ regarding the West Bank wall and settlements on occupied territories. Therefore, we have determined that the enforcement mechanism of the ICJ needs to be reexamined in order for the organization to be more effective.
