Third, the Constitutional Court is to be praised for not circumventing the generality requirement through applying the other alternatives that Article 5(2) of the Basic Law offers as justifications for an interference with freedom of expression.45 One can argue that the prohibition of National Socialist appraisals and glorification could be based on the “right to personal honor” that is codified as a ground for restricting freedom of expression in Article 5(2) of the Basic Law.
