Article 10 (Force Majeure)
Neither Party hereto shall be deemed in breach of the Agreement and liable for any damages caused by the use of the System to the extent such damages were caused due to force majeure or any other causes or circumstances beyond the reasonable control of the Party affected thereby.
For the purpose of this Agreement, an event of force majeure denotes any event the happening or pernicious results of which could not be prevented even though a person against whom it happened or threatened to happen were to take such appropriate care as might be expected from him in the situation, which the event of force majeure shall include any governmental legislation or action or fire, flood, earthquake, inevitable accidents, war (declared or undeclared), legal restrictions, riots, insurrections, or any other causes of comparable effect beyond the control of the affected party.
