kris contract talk #2 from a paralegal student
So, just thought I would do another post about some other contract talk.
To begin I was vague for a reason. I’m not involved in the suit and have no idea what is going on. I have no idea what Kris wants. I have no clue about anything. I’m only giving my opinion as an EXO fan and someone who also is just in the Kpop community as a whole.
My main point I wanted to make about things with my last post was two things.
1) From what I have studied about contracts and contract nullification is there are sometimes when you have a contract but you are only unhappy with a number of issues yet you don’t want to leave the deal completely. Kris has talked about the issues with him and he’s unhappy with. I just wanted to point out how just because it’s a contract nullification doesn’t necessarily mean that he wants to completely leave the previous contract. He may just want to negotiate on one or two issues. We the people not involved in his legal team have no idea what he wants. It may seem like he wants to leave, and I would say there’s a good argument for it with the contract nullification, but we just don’t know. He may just want to get out of this specific contract and want a new one where he is more satisfied with the terms/conditions in the contract.
2) My other main point was the talk of Kris and the timing of the law suit. How he’s oh so selfish. What about the other members etc etc. As I’ve seen plenty of people on forums, here on tumblr, etc say there just honestly was never going to be a “good” time for this type of thing. It’s better to do things while they’re still fresh imo than to wait and wait and wait. When would be a good time? When they’re doing world tours? There’s always going to be something going on. And at the end of the day it IS a job and every idol in the end is always going to look out for their own best interest’s. Whenever issues like this come up people always like to say so and so is selfish and I think it really is just unfair to say.
3) Is again with the timing. Law suits take a long time. As been pointed out to me and elsewhere on forums and such is that this law suit was filed a month ago. Law suits take time. They aren’t something that out of nowhere someone goes “omg I’m so miserable I think I’ll sue!” Just because you WANT to sue doesn’t mean you WILL sue.
And another thing is that yes I am going at things from a perspective of a US student. I do know a little about South Korea’s justice system but not enough about contracts. However, it doesn’t seem that different in terms of contract nullification from what I have studied.
Please keep in mind I am still a student. I do still have several hours left before I get my degree that will be approved of by the ABA. I have been taught by attorney’s of different types but my main professor is a non-practicing attorney who was a JAG officer in the 80’s.
I do hope you don’t take anything I say as gospel. Everything is just my opinion. At the end of the day the ONLY people who know what is going on are those directly involved in the law suit. Everything else is speculation, gossip, hearsay.
