Proceeding on petition for writ of certiorari to the Supreme Court of Wyoming. The Supreme Court held that where one moving for leave to proceed in forma pauperis and petitioning for writ of certiorari alleged, inter alia, that his plea of guilty to second degree murder, upon which he received life sentence, was induced when he had no counsel present and that prosecutor willfully supressed testimony of two eyewitnesses to alleged crime which would have exonerated him, and there was nothing in record to show that adequate hearing on allegations was held in state district court or any hearing of any nature was held in, or by direction of, the state supreme court, and nothing appeared in record to justify denial of hearing on allegations, motion and petition would be granted and judgment would be vacated and cause remanded for a hearing.
