2.2.1. In general
To make such a claim, parties must ensure the correct applicable law. It is very likely that a multimodal transportation contract involves foreign interests. According to Article 145 of the Civil Law2
and Article 126 of the Contract Law, the parties to a contract involving foreign interests may select the applicable law for reso- lution of a contractual dispute, except as otherwise stipulated by law. The applicable law includes domestic laws, foreign laws and international conventions. In addition, if the parties to a multi- modal transportation contract involving foreign elements have not stipulated a choice, then the law of the country to which the contract has the closest connection shall apply (Contract Law, Articles 317). If a multimodal transportation contract does not involve foreign interests, or the parties elect to apply Chinese law, then the relevant laws of China will apply.
