2.2 Scope of Operating Services
2.2.1 The Operating Services shall include elements, but not limited to the following:
(a) Control Room Operation
(b) Train Operation
(c) Station Operation
(d) Safety Management
2.2.2 The Operating Services apply to all parts of the Railway System including those added to or deleted from the scope of work in accordance with clause 12 of the Agreement. Any parts of the Railway System added to the scope of work will be subject to all of the provisions of this Agreement.
2.2.3 The Operating Services include the provision of all labour and the provision of all those materials necessary for the following:
(a) the planning and management as described in Appendix D;
(b) the performance of all Operating Services in accordance with the System Operating Plan and Operating Services Plan;
(c) the planning and performance of all necessary safety audits and inspections in accordance with the requirements of the approved Operations Safety Management Plan;
(d) the operation and maintenance of registers for the reporting and recording of all incidents affecting operation of the Railway System;
(e) the establishment and maintenance of an incident management system in accordance with the Contingency Plan such that an immediate response to an incident shall be possible 7 days a week and for 24 hours a day;
(f) immediate action in response in the event of any major incident including all necessary support to emergency services and the MRTA’s representatives and subsequently to assist in the MRTA’s investigation into the cause of the incident;
(g) subject to the approval of the MRTA, the updating, detailing and, as necessary, revision of the operating procedure manuals and of any other operating procedures in such a way as to take account of weaknesses in providing service to the public as recorded during operation of the Railway System;
(h) the performance of the organisation planning functions specified in Appendix D and the submission of the documentation to the MRTA as required thereby;
(i) the performance of such organisational, recruitment, training and personnel management services, in accordance with the documentation approved by the MRTA, as are necessary to ensure that the Operating Services are at all times performed by a fully staffed organisation composed of qualified individuals;
(j) the examination of all employees recruited and trained by the Concessionaire, and certification of all employees who meet the appropriate standard;
(k) the provision of all resources necessary for personnel training described above;
(l) the co-ordination and planning necessary to provide for turnover to the MRTA of a self-sufficient operating organisation on a phased or one-time basis as required by the MRTA and as further described in Appendix F;
(m) the furnishing to the MRTA of regular reports regarding the progress of the Services and prior to the commencement of the Services regarding the preparations thereto as further specified in this Agreement;
(n) assistance to the MRTA in producing reports relating to the Services for the Railway System as may be required by third parties;
(o) assistance to the MRTA in determining the cause of failures for the purpose of monitoring performance against the service level targets defined in Appendix A.
