Kmart to pay $300,000 to woman who ‘permanently injured her buttock’ on $8 chair

Kmart has been forced to pay a woman $300,000 after an $8 garden chair she was sitting on collapsed, causing her to "permanently injure her buttock".

Julie Ann Lewis was sitting on the garden chair in the Nowra Kmart store when it reportedly collapsed.
The 63-year-old reportedly injured parts of her legs, her lower back and her right buttock as a result of the chair collapsing.

The NSW District Court heard Ms Lewis went to process photos but there were no steel seats available to sit on at the photo desk.

Despite a warning on the garden chairs that said they were only for domestic use, Ms Lewis reportedly carried one to the desk from the gardening section.
Judge Gibson said Kmart staff had been aware of the chair shortage for some time.
“The defendant's failure to provide adequate seating for its customers in the photo lab, training for its staff and regulation of equipment use all play a role in relation to the circumstances of the accident," she said.
