Ms. Thomas had previously filed
five
complaints with Orion corporate Human
Resources, in accordance with
published
Orion
procedures contained in the Orion
Employee Manual.
In her complaints she alleged that Ms. Jones, who had a prior
consensual romantic relationship with Ms. Thomas prior to her beginning her sexual
transition, continued to make unw
anted sexual advances to Ms. Thomas
. Ms. Thomas
claims to have clearly informed Ms. Jones that her action
s
were unwelcomed and that
s
he felt very uncomfortable with her actions. Ms. Thomas claims that Ms. Jones
continued to
aggressively harass
h
er
and told
her on a number of
occasions
that "she
would make
her
want to stay a man" and other offensive comments.
Additionally, when
Ms. Thomas began her transition process and her appearance began to change, she
began to receive vulgar and d
isparaging comments from a number of the hotel staff.
Human Resources claimed to have
investigated each complaint and dismissed each
one as unfounded
