In theory, under Section 42a,8)_and_footnotes(n168);.vk n168 if the author of a musical work or of its text has authorized the making and distribution of sound recordings of the work for commercial purposes, that author or his successor is required to grant a similar license to any other producer. However, this non-voluntary license is not applied in German practice because Section 42a further provides that no non-voluntary license shall be effective for any right which a collecting society lawfully administers. In Germany, the collecting society GEMA administers the right for the production of sound recordings of musical works, that is, the so-called mechanical right.
