8 Tender Breakdown
8.1 Conditions of Contract
• Our proposal is for a double pass pallet type freezer with end flow air circulation
• Hydraulic power pack is approximately 1.25 meters x 1.0 meters and is located adjacent to the tunnel.
• The tunnel functions will be controlled by an independent PLC located in our Switchboard.
8.2 Connection Points
• Conveyors – Start with our infeed elevating conveyor and finish at the 3 palletizing spurs
• Evaporators are standalone.
• Electrical installation terminates at our switch board, to be located adjacent.
8.3 Validity
• 30 days from date hereof.
8.3.1 Terms of Payment
1. A deposit of 30% of the contract price with order.
2. A further 65% in the form of monthly progress payments for equipment on site and off site, installation of, commissioning, engineering and any other works relating to the substantial completion of the Subcontract Scope of Works.
3. The final 5% on practical completion of the project.
4. Monthly progress payments will include variation sums for work and equipment on and off the site.
5. Other payment terms may be negotiated to suit.
8.4 Practical Completion
Shall be either when the plant is running substantially complete and approved by the local regulatory authority for processing, except for defined minor items, or when the plant has been successfully used in processing for a total operational time of at least 40 hours, whichever is the earlier.
If, however, by reason of any act or omission of the Principal, or of the Engineer, or of some other contractor employed by the Principal, the Contractor is prevented from commissioning part, or all of the plant, or conducting performance testing on part or all of the plant, then for the purpose issue of Practical Completion Certificate, such commissioning and performance tests shall be deemed to have been satisfactorily completed and the Contractor shall be entitled to claim a Practical Completion Certificate.
Nevertheless, the Contractor shall during the maintenance period, carry out any commissioning and testing procedure which has been omitted, as and when required by the Engineer, who shall give 10 day’s notice of such requirements.
Any additional cost and expense including profit by the Contractor as a result of carrying out deferred commissioning and performance testing procedure during the maintenance period shall be paid as a Variation to the Contract
