Nuclear tests are not comparable to the use of waters by an upper riparian or to the emission of noxious fumes by factories. They are an activity sui generis by reason of their motivation, their sheer physical size and their potential consequences. The trespass to which they give rise is not transient or short-lived it is long-enduring.
