it appears that mr.chatree or ak&a will dispute the fact that the balance of fees is payable to aka, rather than o him personally or to ak*&a, but the burden of proof lies upon him or ak&a to show that they areentitled to the funds. we welcome any further documentation that mr.chatree or ak&a cna provide documentation proving that the contract was transferred from aka to him or ak&a. However, in the absence of any such evidence, mr.chatree or ak&a should be required to procure that aka sign a release consenting to the payment of the outstanding ees directly to mr.chatree or ak&a. the release should also contain an indemnity under which mr.chatree and ak&a agrees to hold NHI harmless from any claim from aka (or any other party) in respect of the fees.
