Did you mean that the damage of the container is not caused by Hal TL?
There are two points here:
- I have see your attached files. And the photos you sent us are taken after goods was unload. Therefore, it cannot be convincing proof that Hal TL have no responsibility for that damage.
- I have check the process of loading at Hal VN. There is container in which goods was loaded not by Forklift, but by pulling due to that container loading bridge is not available. Additionally, products are packed in paper pallet. Therefore, the possibility of making container sidewall panel is really low.
Following DDU term, damages caused by loading is paid for by Hal VN, damages caused by unloading is paid for by Hal TL. But, at present, who is responsible for that damage is uncertain (Hal VN, Hal TL or third party – who made containers scratched before hal Vn loaded goods).
Therefore, I would like to propose that the payment for previous damage (Shipment 1507-06) is paid for by Hal VN. And this damage is paid for by Hal TL.
