Latest reforms to Temporary Foreign Worker Program are aimed to give top priority to Canadian permanent residents and Canada citizens with regard to getting employment.
Reforms to Canada temporary foreign worker program—Changes to TFWP(Temporary Foreign Worker Program) have been announced. These changes were revealed on 29th April this year by Minister of Citizenship and Immigration and Minister of Human Resources and Skills Development.
As per the details of the latest changes, new rules will make it expensive as well as difficult for employers to hire temporary foreign workers for Canadian jobs.
What are the changes to Canada temporary foreign worker program?—following changes have been announced to TFWP—
• Prevailing wage rate—Latest changes will ensure that employers in Canada hiring temporary foreign workers for working in Canada will have to pay prevailing wage rate.
Prior to the recent changes, nearly 15 percent lesser wages were paid by Canada employers to foreign workers working on high-skilled job positions.
Moreover, around 5 percent below the prevailing wages were paid to temporary foreign workers for low-skilled job positions in Canada.
• Suspension of A-LMO(Accelerated Labor Market Opinion)—Suspension of A-LMO is yet another significant change to TFWP.
A-LMO has been suspended temporarily. It may be notable that applications for regular LMO consume around two months or a little more (dependable on the individual circumstances) as compared to just 10 days for processing of A-LMO.
• More powers for revocation, suspension of LMOs, work permits—Government of Canada will have higher powers to revoke and suspend work permits and LMOs as per the Bill C-60(Economic Action Plan 2013 Act, No. 1).
So, Citizenship and Immigration Canada(CIC) and HRSDC(Human Resources and Skills Development Canada) will have the authority to refuse, suspend or revoke processing of an LMO application if the TFWP was misused and it is determined by any official.
• Top priority to Canadians for Canada jobs—To make sure that Canada permanent residents as well as Canadian citizens get top preference in getting Canadian jobs, LMO forms will have new questions as per new rules for TFWP. It simply means that employers as well as their partner firms will have to give more information before they are issued an LMO.
Such questions could be about outsourcing jobs and also if Canadians are going to be replaced by temporary foreign workers.
• Language—French and English will be the two languages needed for Canadian jobs(either of two languages).
• Fees—New fees will be introduced for LMO applications along with higher fees for Canada work permit applications.
• Transition to Canadian workers—Plans are to design and implement a transition plan to a Canadian workforce under the LMO application process.
