In April 2015, Alibaba Group launched two
new policies with the objective of enhancing thprotection of IP rights on the Web platforms controlled
by the Group. Because of the exponential
growth of e-commerce in China and the number of
risks associated with online counterfeiting for brand
owners and consumers, those new policies may have
a great impact on the worrisome situation of online IP
rights infringement.2
This article provides some background information
on the above mentioned SAIC investigation
of online practices related to IP infringements.
Then it explores the main changes introduced by the
“good-faith take down mechanism,” and the “3 strikes
out policy.”3
The article concludes with some comments
on those procedures and assesses how they will
improve the protection of trademarks against online
infringements.
