I am not going to put too much time in responding to you because we all know that it won’t go anywhere other than causing more aggravation, but for what it is worth here is a one time answer that is intentionally made as simple as possible so you can understand it.
1. Business decisions are based on majority and not James Burger alone.
2. You are no longer taking care of the factory. That is the past.
3. Your fellow shareholders and directors are trying to save whatever can be saved (including themselves) from the fiasco YOU have created, so please forgive us if your personal aspirations are not part of our priorities.
4. The tax lawyer has been hired today based on a majority decision of the board of directors.
5. Decisions about payments are based on majority of the board of directors.
5. The assets currently stored in the Eco factory do not belong to you alone. Some of them belong to Wimon as well. Antje and me will not claim any rights over these assets. Nothing to worry about.
6. Neither Antje nor me have the keys to the factory.
7. It has been decided on a majority basis that until we have clarity and a clear course of action from the tax lawyer no assets will be moved around. We will keep you updated on this.
8. The tax lawyer will inform all of us about the risk and responsibilities once he has seen all the data.
9. I hope you understand that if your fellow shareholders should lose the fruit of their work from the past ten years because of your negligence, you may have to deal with more than just the RD moving forward, so I think it is in your interest to be as cooperative as possible and have the decency to admit to yourself that you are not exactly in a position to dictate anything at this point.
10. Whatever is (or has been decided) has not been decided in a spirit of attack or offense, but entirely in defense or protection (even though it may not look like it from where you stand). Let’s make sure it stays that way.
11. Lastly, Neither Wimon nor Antje nor me are responsible for the RD fiasco. Except for a few months last years, you have been entirely in charge of the financial aspects of Ecosphere all along. Only you should carry this responsibility. If unexpected losses should occur because of the RD situation I can only suggest that you settle this amicably with the parties concerned. If you honestly and deeply listen inside of yourself you will perfectly know what is right and wrong and you will have to admit (at least to yourself) that you screwed up pretty bad on this one.
