2. In implementing the provision contained in paragraph 1 of this article, each State Party shall give
appropriate consideration to humanitarian and compassionate factors.
Protocol Annotation: If domestic law does not allow trafficked persons to remain in the
country temporarily or permanently, then it is quite important to include this provision in the
law. Section 7.2 ensures that immigration laws are interpreted in a manner that takes into
consideration the specific situation of the trafficked person prior to deciding whether or not
she or he can remain in the country.
