20. ARBITRATION:Any disputes, controversies or differences which may arise out of this Purchase Order or in connection with the execution of the same shall be solved in an amicable manner.If, however, both parties fail to reach an agreement through such amicable manner, the arbitration proceedings shall be go to arbitration under the Rules and Procedures of the Thai arbitration Act B.E. 2530. The place of arbitration shall be in Bangkok, Thailand.The arbitration shall be conducted in the English Language and composes of three (3) arbitrators. Each Party shall nominate one (1) arbitrator for confirmation in accordance with the Rules. Where each Party has nominated an arbitrator in accordance with the Rules and each such nomination has been confirmed, both arbitrators shall agree on the third arbitrator who shall act as chairman of the arbitration (“Chairman”) herein.Should the two arbitrators fail to reach agreement on the Chairman within thirty (30) days after the date of confirmation of the second arbitrator, the Chairman shall be selected and appointed by the Rules.The award made pursuant to said Arbitration shall be final and binding upon both parties.Notwithstanding any reference to the amicable settlement or arbitration herein, the parties shall continue to perform their respective obligations under this Purchase Order unless they otherwise agree in writing.
