Effective date, terms, and termination
The Employment shall commence on 1 march 2016
The duration of the employment is unlimited.
The probation period is 6 months.
In deviation of clause 13.2 of the general employment policy, the notice period is 1 month as per the end of a calendar month.
Position
The employee’s job function is engineer, Technical service.
The employee reports functionally to project Manager.
The employee works full time.
The employee’s work place is Bangkok.
Remuneration
The annual fixed salary of a gross amount of thb 252,000 per annum, and
The employee shall be entitled to annual fixed bonus as per the company condition of employment, see general employment policy.
Non-compete clause
The employee will not for a period of six months after the end of her employment with the employer solicit with or accept orders for services competing with the employer or any affiliate from any of the employer’s or its affiliates’ customer, with whom the employee dealt during the last twelve months of her employment with the employer.
The employee will not for a period of twelve months after the end of her employment with the employer poach from the employer of its affiliates and person who, when the employee’s employment ended, is or was employed by the employer or an affiliate.
Affiliate shall mean any parent company, subsidiary, or associate company of the employer within the DKSH Group of companies.
If the employee is in breach of this provision, the employee agrees to pay the employer compensation equivalent to the annual fixed salary, in addition, the employee agree that the employer shall be entitled to further damages as remedies for and such breach.
Application of policies
In addiction to the provisions of this employment contract, the employee agrees that the general employment policy, instruction, policies, and regulation (including anu amendments in respect the of)to bee issued from time to time by the DKSH Group of companies (Jointly the Policies) apply to the employee’s employment.
Whereby the policies do not form part of the employment contract, and therefore do not vest enforceable rights in the employee, the employee agrees to abide by and comply with the terms and conditions of the policies at all times to the extent permitted by law.
Unparticular, the employee will receive an e-mail to the personal e-mail account giving access to the entry page of the DKSH Brand portal and to the relevant set of policies. The employer reserves the right to alter, supplement or revoke such policies at any time.
Governing law
This employment contract is governed by the substantive laws of Thailand, whereby Thai conflicts of law rules are hereby excluded from application to this employment contract.
