10.1 In the event that ICBCTL shall be prevented from performing any Service or a material part thereof on account of a Force Majeure event;
(a) ICBCTL shall immediately notify the Bank and shall take all steps within its power to overcome the circumstances preventing due performance with all reasonable despatch;
(b) without prejudice to the provisions of (a) above, the obligations of ICBCTL under any Service Level Agreement as regards the Service affected by the Force Majeure event shall be suspended, and
(d) if the Force Majeure event subsists for more than 15 (fifteen) days, the Bank shall be entitled, without prejudice to any other rights or remedies it may have, forthwith to terminate this Agreement or the relevant Service/Services by written notice to ICBCTL, in which event Clause 9.5 shall apply.
10.2 For the purposes of Clause 10.1 above, a Force Majeure event means acts of God, acts of governmental authorities, forced entry into the Premises by unauthorised persons, strikes or other industrial action, war, hostilities, acts of terrorism, riot or other civil disturbance.
