Tour business means to provide foods, accommodations, transportation and guide the customers to their desired destinations. (section 4 of the Travel Agency Business and Guide Act, B.E. 2535 (1992) and B.E 2551 )

Under the Tourism Business and Guides Act B.E. 2551 (2008), in order to provide travel agency and tour operator services, a licence must be obtained from the Bureau of Tourism Business and Guide Registration, at the Department of Tourism of the MOTS. Companies must be incorporated under Thai law, have no less than 51% Thai capital, and half of the board of directors must be Thai nationals, in order to apply for a tourism business licence.

The provision of tourist guide services is reserved for Thai nationals under the Tourism Business and Guides Act B.E. 2551 (2008). The person must be trained and pass the exam conducted by universities providing tourism and tour guide training courses, and register as a tour guide with the Bureau of Tourism Business and Guide Registration at the Department of Tourism. Due to the shortages of guides speaking foreign languages, the MOTS is considering the possibility of allowing foreign language speaking tour leaders to work as interpreters in Thai territory in the company of local guides. According to the authorities, there is no discrimination between domestic and foreign service suppliers as long as foreigners wishing to undertake tourism business in Thailand obtain a licence from the Bureau of Tourism Business and Guide Registration.

Under the Immigration Control Act 1979 and Announcements of the Interior Ministry (dated 1 October 2002, 20 December 2002, 18 October 2004 and 6 May 2005), nationals from 42 designated countries or territories may travel to Thailand for tourism purposes without a visa and are allowed to stay for a maximum of 30 days on each visit.

Natural person:
A. Being of Thai Nationality
B. Being not less than twenty year old of age.
C. Having residence in Thailand
D. Not being insolvent- their assets not being
frozen
E. Not being a lunatic or incompetent or quasi-incompetent person
F. Not Being a person whose license is being suspended.
G. Not being a person whose license has been revoked. If license has been revoked, the revocation must have occurred not less than five years previously.


Juristic Person:
A Thai company has to be put up first and then the TAT license can be applied for afterwards.
A. Being registered under Thai Law;
B. Aiming to set up the business for tourism;
C. Juristic Person Partnership and all of unlimited- liability partner must be Thai Nationality.
D. Limited Company and Public Company Limited, Not less than half of directors must be Thai Nationality and not less than Fifty-One percent (51%) of capital must be owned by natural persons that are Thai Nationality.
E. The partners of juristic person must not be the person whose license is being suspended. And a person whose license has been revoked. If license has been revoked, the revocation must have occurred not less than five years previously.

Required Documents
TAT license application form, signed by a Thai director and stamped with the seal of the company
Certificate of Registration and objectives of the company under the Civil and Commercial Code (not older than one month). Do note, only a Thai director has the power to sign and stamp the seal of the company.
List of shareholders’ names, certified by The Minister of Commerce
Memorandum of association which must be certified by The Minister of Commerce
Company’s regulation or report of company establishment’s meeting (If the company has no the company’s regulation) which must be certified by The Minister of Commerce
Copy of the director’s personal ID card and his registered address which must be certified by the director
Seal of the company
Two photos of the front of the office (showing the address and nameplate)
A map of the office
Ownership or possession evidence of the office
Power of Attorney
Guarantee, cash or cashier’s check which is used as security

The applicants can appeal in case of the license is not approved

The appeal has to be occurred within 30 days from the date of being noticed

The license of tourism has to be disclosed at the noticeable area

The tour advertisement has to comprise: 1) name of business2) location and the license number 3) the period of tourism4) service fee and method of payment5) type of transportation for tourism6) destination, resting areas, and all the main tourist attraction 7) type of accommodation and number of meals serviced 8) number of tour guides9) minimum amount of tourists

The change of tour details have to be informed before payment process

The change of tour details occurred after payment is not engaged by the tourist. If the tourists are willing not to attend the tour, all the refund has to be proceeded as soon as possible and no additional charge

Apart from service fee, any other additional charge cannot be paid in advance 
Tour cancelling such as because of the tourists themselves or as the results of any other causes (but not the fault of the tour operator), the tour operators still have to refund every tourists their touring expense, such as the price of tickets, accommodation. The amount of refund is as indicated by the committee.

In case of tour has to be cancelled as a consequence of the amount of the tourists less than as required (as identified in section 26 (3)) and also as a result of any other circumstance caused by the travel agency itself, the travel agency has to refund the tourists all their expense
