Abnormal Conditions - Conditions that would not normally occur and are therefore not included in the pricing presented in this Agreement. Abnormal Conditions shall include, but not be limited to, the following situations:
i. any accident involving or causing wheel or brake damage, unless the accident is the direct result of a malfunction of Seller’s wheel or brake itself;
ii. actual or simulated rejected takeoffs;
iii. malfunction of the aircraft hydraulic system or skid control components and system which causes or contributes to damage or unusual wear of the brake;
iv. any wheel or brake that is damaged or made unable to be repaired as the result of negligence or misuse by Buyer, its employees, or representatives;
v. use of any wheel or brake containing components not approved by Seller;
vi. wear and/or damage caused by: a) improper maintenance, including failure to follow the Aircraft Manufacturer’s Aircraft Flight Manual (“AFM”), Aircraft Maintenance Manual
