Unfair cartel case of 21 contractors in bidding procedures
for turnkey projects for Incheon urban railroad line 2

21 contractors who had participated in the bidding procedures for 15 lots of the
project for the construction of Incheon urban railroad line 2 were found to have
colluded in bidding by selecting successful bidders and acting as sham bidders, and
the KFTC imposed fine of 132 billion 200 million won against them, along with an
order to take corrective remedies, and filed a criminal complaint with the
prosecution against 15 corporations involved in the case.
A. Facts of violation
It was found that 21 businesses made an arrangement on a successful
bidder from among them and shame bidders for each lot of the project
for the construction of Incheon urban railroad line 2 through individual
meetings and conversations over wired and wireless phones in order to
avoid competition before participating bidding procedures in April 2009.
They put the arrangement into action in such a manner that businesses
participating as sham bidders presented lower-quality design documents
(namely sham designs or design B) so that the designs proposed by them
could be evaluated as lower in quality than the design proposed by the
prearranged successful bidder.
B. Countermeasures taken
The KFTC imposed fine of 132 billion 200 million won in total aginst
the corporations involved in the case, along with an order to take
corrective remedies, and filed a criminal complaint with the prosecution
against 15 companies involved in the case by applying the Article 19 (1) 8
(Determination of Successful Bidder, Bidding Price, or Successful Bid Price
in Bidding Procedures) of the MRFTA.
