The legal system is slowly beginning to heed the now-famous words of
Abraham Lincoln: "Discourage litigation. Persuade your neighbors to compromise
whenever you can. Point out to them how the nominal winner is often
the real loser - in fees, expenses, and waste of time. As a peacemaker, the
lawyer has a superior opportunity of being a good man."'2 3 It is time for those
jurisdictions which are lagging behind to take the necessary steps to recognize
and encourage the legal system's most creative and promising solution yet to
the problems of divorce in America.
