employer will now be known as a “person conducting a business or undertaking” (PCBU). A PCBU includes employers, corporations, associations, partnerships, sole traders and some volunteer organisations.
• Most of the duties for a PCBU under the new WHS Act are similar to those an employer had under the previous OHS Act. The main duty for the PCBU is to ensure the health and safety of workers by eliminating or minimising risks in the workplace.
• There are additional duties for a PCBU who:
o manage or control a workplace
o control fixtures, fittings or plant
o design, manufacture, import or supply plant, substances or structures o Install, construct or commissions plant or structures.
