13.2 Relief and extension of time
If the contractor wishes to claim relief by reason of force majeure he shall notify “KPN” in writing immediately upon the commencement and upon the cessation thereof. The extent of the relief and of the extension of time shall be determinated by “KPN” according to clause 4.9 hereof.



14. Patents

The contractor shall save harmless and indemnify “KPN” and the client from and against all claims and proceeding on account of infringement of any patent right, design, trademark, or other proprietary rights.

15. Approval

This contract is subject to that the contractor is approved by the client.

In case such approval is not obtained, the contract shall be deemed null and void and the contractor shall have no claim whatsoever against “KPN”.

16. Disputes

16.1 Notice for arbitration
If any dispute or difference shall arise between “KPN” and the contractor in connection with or arising out of the contract or the carrying out of the works, whether during the progress of the works or after their completion and whether before or after the termination, abandonment or breach of the contract, and which cannot be settled amicably, either party shall as soon as reasonably practicable, but not later than three months after a request to settle the dispute amicably has been made to the other party, give to the other notice in writing of the existence of such dispute or difference, specifying the nature and the point at issue, and the same shall be finally settled by arbitration. The procedure for such arbitration is specified in the Appendix 2 of the contract.

16.2 Works to continue
Performance of the contracts shall continue during settlement negotiations and arbitration proceeding unless “KPN” order the suspension thereof, and if any such suspension is ordered, the reasonable additional expenses of the contractor occasioned by such suspension shall be included in the contract price if the arbitrators so decide. No payments due by “KPN” shall be withheld on account of pending arbitration.

16.3 Applicable law
This contract shall become effective according to and in all respects be governed by and constructed in accordance with the law stated in Appendix 2.
