(1) Shall keep the RL information strictly confidential and shall not disclose the nature of the same to any other party (other than for the proper purposes of (1) above in which case the Bidder shall ensure that any such third party shall undertake obligations similar to those herein undertaken by the Bidder) except such information which the Bidder can prove, to RL's satisfaction, is available to the public, or was in writing and already in its lawful possession at the time the RL Information was furnished to the Bidder, or was rightfully received by the Bidder from a third party not subject to any secrecy obligation.
